Terms of Service

1. Service Description
Appointed ("we", "us", "our") provides salon booking software, Stripe Terminal point-of-sale, recurring appointment management, a client self-service portal, and an AI receptionist service. These terms govern your access to and use of the Appointed platform at appointedbooking.com and related applications.
Appointed is delivered as managed, multi-tenant software-as-a-service. Access is granted under a subscription purchased through our sales team or through the online signup flow.
2. Acceptable Use
When using Appointed, you agree not to:
- Use the service for any unlawful purpose or in violation of applicable laws
- Send unsolicited commercial messages to clients in violation of Canada's Anti-Spam Legislation (CASL)
- Collect or store personal information about clients without their knowledge and consent
- Attempt to reverse-engineer, decompile, or extract the underlying technology
- Interfere with the integrity, security, or availability of the platform (including attempts to bypass tenant isolation)
- Abuse, manipulate, or attempt to exploit the AI receptionist to obtain information that does not belong to you
- Resell, sublicense, or otherwise make the platform available to third parties outside your business
3. Account and Tenant Responsibility
You are responsible for maintaining the confidentiality of your staff accounts, controlling who has access to your tenant, and ensuring that your use of the platform complies with applicable laws. You are responsible for the accuracy of the client, booking, and service data you enter into Appointed, and for obtaining any required consents from your clients.
4. Payment Terms
Subscriptions are billed on a monthly or annual billing cycle as selected at signup. Fees are charged in advance at the start of each billing period via the payment method on file.
Stripe processes payments taken through Appointed Terminal. Stripe charges its standard card-processing rates directly; Appointed does not add a markup on card processing. Stripe payouts land in the salon's connected Stripe account on Stripe's normal schedule.
Either party may cancel the subscription with 30 days' written notice. Upon cancellation, service continues through the end of the current billing period. No refunds are issued for partial months. Upon termination, your tenant data is exported and returned on request, then securely destroyed within 30 days unless a longer retention period is required by law.
5. Service Availability
We target 99.9% monthly uptime for the core booking platform, measured excluding scheduled maintenance windows communicated in advance. AI receptionist availability depends on upstream providers (ElevenLabs, Twilio); outages originating with those providers are not counted toward our uptime target. Service credits for unplanned downtime are available on request and are our sole liability for availability failures.
6. Data Handling and Privacy
We take your privacy and your clients' privacy seriously. Our collection, use, and protection of personal information is described in our Privacy Policy. By using Appointed, you acknowledge that you have read and understood our privacy practices. For client data stored in your tenant, you are the data controller and Appointed acts as your data processor.
7. Intellectual Property
Appointed and all related trademarks, software, designs, and documentation remain the property of Appointed and its licensors. Subscribing to Appointed grants you a limited, non-exclusive, non-transferable licence to use the platform for the duration of your subscription. Content you upload into your tenant (client lists, service catalogues, branding) remains your property.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Appointed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising out of or related to your use of the platform.
Our total liability for any claim arising under these terms shall not exceed the total subscription fees you paid to Appointed in the three months preceding the claim.
9. Governing Law
These terms are governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law principles. Any disputes arising under these terms shall be resolved in the courts of Ontario, Canada.
10. Termination
We may suspend or terminate your access to Appointed for material breach of these terms, non-payment after a reasonable cure period, or conduct that jeopardizes the security or integrity of the platform for other tenants. We will provide written notice and a reasonable opportunity to cure wherever practicable.
11. Changes to These Terms
Appointed may update these terms from time to time. Changes will be posted on this page with an updated effective date. We will make reasonable efforts to notify active subscribers of material changes. Continued use of Appointed after changes are posted constitutes acceptance of the updated terms.
